Question:

180 Mr. Costello asked the Minister for Justice the action, if any, she proposes to take in relation to the question of affirming in court in view of the case of a person (details supplied) in County Leitrim; and if she will make a statement on the matter.

If the question refers to legislative action, I have to repeat what I have informed the House in the past, that is that I could not be expected to outline, in a response to a Parliamentary Question, what particular legislative proposals I may have in mind. Any such proposals would have to be brought before Government for approval in the normal way.

If the question is inquiring what action other than legislation I may consider, then I have to say that the courts are totally independent in the conduct of court business, as provided for in the Constitution, and it is not open to me to take any action in relation to any particular case.
