Written Answers. - Mischievous Complaints to Garda.

Question:

182 Mr. Gilmore asked the Minister for Justice if a person against whom a mischievous complaint is made to the Garda and on whom a file is sent to the Director of Public Prosecutions who does not pursue the matter is entitled to be informed of the identity of the complainant and to have access to a copy of the statement made.

The question raises an issue of legal interpretation in which, for example, the privilege attaching to the documents in the particular case would arise. It would not, in my view, be either possible or appropriate to address an issue of this nature in the course of a reply to a parliamentary question.
