Written Answers. - County Kerry Commonage Division.

Question:

281 Mr. Deenihan asked the Minister for Agriculture, Food and Forestry when a decision will be made regarding the division of the Behaghan Commonage, Castlecove, Killarney, County Kerry; and if he will make a statement on the matter.

There have been two applications to divide commonages in the townland of Behaghan, County Kerry. The legal formalities in relation to one case were completed in April 1988 and the documents necessary for registration were sent to the Land Registry and lodged there under Dealing Number 1293/88.

The second application has been made to the Land Commission to divide a commonage using compulsory procedures as one of the shareholders is not willing to divide. At present the Land Commission is awaiting the final resolution of an appeal to the High Court against the compulsory division of another commonage in County Mayo before continuing with these types of division. If the shareholders in the Behaghan commonage have reached agreement on the division of their commonage they should contact the Land Commission and the feasibility of dividing the commonage using voluntary procedures will be examined.
