Question:

121 Ms McManus asked the Minister for the Environment if, in view of the threat to commonage by enclosure by farmers he will ensure that this commonage can be protected in the public interest either through the local authorities or the Office of Public Works.

The protection of commonage is not a function of local authorities and they have no specific powers in this regard. Local authorities, however, have powers in relation to the creation of public rights of way, the making of agreements to restrict or regulate the use of land, and the making of special amenity area orders in relation to areas of outstanding natural beauty, special recreational value, or where there is a need for nature conservation. Moreover, in certain circumstances, the fencing or enclosure of land which has been open to or used by the public may require planning permission.
