91 Mr. Nealon asked the Minister for Transport, Energy and Communications if there is a statutory requirement, or a requirement established by precedent, that in major developments the ESB has to receive approval from him or his Department, or has to consult with him or his Department; and if he will make a statement on the matter.

92 Mr. Nealon asked the Minister for Transport, Energy and Communications if new ESB capital programmes at a certain level have to be sanctioned by him or by the Government; and if so, if he will give details of the nature of such a regulation.

I propose to take Questions Nos. 91 and 92 together.

Section 2 of the Electricity (Supply) (Amendment) Act, 1982 provides that the Board of ESB shall not incur any expenditure for capital purposes without the approval of the Minister.
