Question:

256 Mr. Gregory asked the Minister for Justice if, arising from her reply to Parliamentary Question No. 113 of 30 November 1993, she is in a position to give the appropriate replies as the matter is no longer the subject of legal proceedings.

As I said in reply to a subsequent Parliamentary Question (No. 65 of 15 December, 1993) this State has not and will not authorise any person of the kind described by the Deputy to operate within this jurisdiction and any evidence of an attempt to do so would be a matter for investigation by the Garda authorities. Garda investigations in the case referred to have not revealed evidence of the commission of any criminal offence within this jurisdiction.

Question:

257 Mr. Gregory asked the Minister for Justice if, arising from her reply to Parliamentary Question No. 186 of 6 October 1993, and a subsequent reply, she will give the present position regarding the person concerned and the accommodation available to her.

I have previously set out my Department's responsibilities in this matter and indicated that, arising from discussions between officials of the Departments of Health, Education and Justice, it is considered that unless there is a requirement for custody on conviction for criminal offences, the person concerned should be cared for in a Health Board related facility. That remains the position in this case. I am informed by the Minister for Health that the person concerned is living with her parents at present. It is the intention to offer her a place in an Eastern Health Board facility but refurbishment of the accommodation which has been identified as a suitable placement for her is not expected to be completed until April.
