Written Answers. - Local Authority Planning Exemption.

Question:

325 Mr. Molloy asked the Minister for the Environment if local authorities developing hard stands for travellers are exempt under the Planning Acts; if any changes are proposed; and if he will make a statement on the matter.

Development by a local authority in its own functional area is exempted development for planning purposes and does not, therefore, require planning permission. There are no proposals to alter this position, but some categories of local authority development, which will be specified in regulations under section 78 of the Local Government (Planning and Development) Act, 1963 as amended by section 3 of the Local Government (Planning and Development) Act, 1993, will be subjected to new requirements of public notice and consultation.
