Question:

101 Mr. Bree asked the Minister for Health if he will introduce legislation or regulations which will include specific penalties prohibiting persons qualified to prescribe or supply medical products from accepting or soliciting hospitality or gifts from pharmaceutical companies; and if he will make a statement on the matter.

The Medical Preparations (Advertising) Regulations 1993 provide that a health professional shall not accept or solicit any inducements, including hospitality or gifts, unless such gifts are inexpensive and relevant to the practice of medicine or pharmacy or that the hospitality is reasonable in level.

These regulations were made under the Health Act, 1947 which provides for penalties for any breaches of them.
