Question:

129 Ms O'Donnell asked the Minister for the Marine in regard to the area of his responsibility, the Directives or other measures requiring transposition under EU law which have been adopted by the EU Council or Commission but which have not yet been transposed by Ireland; the Directives or measures requiring transposition where the date for transposition has passed; the Directives or measures or other matters of EU law in respect of which the European Commission has issued a letter to Ireland under Article 169 (Infringement Proceeding) of the EC Treaty; the Directives, measures or matters in respect of which the European Commission has issued a reasoned opinion to Ireland under Article 169; the matters in respect of which proceedings against Ireland are pending before the Court of Justice of the European Union; the matters in respect of which a judgment of the Court of Justice of the European Union against Ireland has been given but has not been implemented; and the judgments in respect of which proceedings have been initiated under Article 171 (Failure to Implement Judgement) of the EEC Treaty.

The information requested by the Deputy in so far as the Department of the Marine is concerned is set out in the following statement.

(a) The Directives or other measures requiring transposition under EU law which have been adopted by the EU Council or Commission but have not yet been transposed by Ireland:

Council Directive No. 91/67/EEC concerning the animal health conditions governing the placing on the market of aquaculture animals and products (due for transposition into Irish law on 1 January 1993).

Council Directive No. 91/492/EEC laying down the health conditions for the production and the placing on the market of live bivalve molluscs (due for transposition into Irish law on 1 January 1993).

Council Directive No. 91/493/EEC laying down the health conditions for the production and the placing on the market of fishery products (due for transposition into Irish law on 1 January 1993).

Council Directive No. 92/29/EEC — minimum safety and health requirements for improved medical treatment on board vessels (due for transposition into Irish law on 31 December 1994).

Council Directive No. 92/48/EEC laying down the minimum hygiene rules applicable to fishery products caught on board certain vessels (due for transposition into Irish law on 1 January 1993).

Council Directive No. 93/53/EEC introducing minimum Community measures for the control of certain fish diseases (due for transposition into Irish law on 1 July 1994).

Council Directive No. 93/54/EEC (which amends Council Directive No. 91/67/EEC above) (due for transposition into Irish law on 1 July 1994).

Council Directive No. 93/75/EEC — minimum requirements for vessels bound for or leaving Community ports and carrying dangerous or polluting goods (due for transposition into Irish law in September 1995).
(b) The Directives or measures requiring transposition where the date for transposition has passed:
Council Directive No. 91/67/EEC concerning the animal health conditions governing the placing on the market of aquaculture animals and products (due for transposition into Irish law on 1 January 1993).
Council Directives No. 91/492/EEC laying down the health conditions for the production and the placing on the market of live bivalve molluscs (due for transposition into Irish law on 1 January 1993).
Council Directive No. 91/493/EEC laying down the health conditions for the production and the placing on the market of fishery products (due for transposition into Irish law on 1 January 1993).
Council Directive No. 92/48/EEC laying down the minimum hygiene rules applicable to fishery products caught on board certain vessels (due for transposition into Irish law on 1 January 1993).
(c) The Directives or measures or other matters of EU law in respect of which the European Commission has issued a letter to Ireland under Article 169 (Infringement Proceedings) of the EC Treaty:
Nil.
(d) The Directives, measures or matters in respect of which the European Commission has issued a reasoned opinion to Ireland under Article 169:
A Reasoned Opinion dated 18 June 1993 was issued by the European Commission to Ireland in respect of nationality requirements for the ownership of merchant ships, pleasure craft and fishing vessels entering in the Irish shipping register. (The conditions of registration of these classes of vessels on the Irish register and entitlement to fly the Irish flag are provided for in the Mercantile Marine Act, 1955). Ireland responded to the Reasoned Opinion in the matter of merchant ships on 29 September 1993. Nothing further has been heard from the Commission to date in the matter.
(e) The matters in respect of which procedings against Ireland are pending before the Court of Justice of the European Union:
Nil.
(f) The matters in respect of which a judgment of the Court of Justice of the European Union against Ireland has been given but has not been implemented:
Nil.
(g) The judgments in respect of which proceeding have been initiated under Article 171 (Failure to Implement Judgement) of the EEC Treaty:
Nil.
