8 Mr. G. Mitchell asked the Minister for Finance the expiry date of each of the cases referred to in parliamentary Question No. 42 of 1 May 1980; if he will make a statement on the matter; the estimated cost to the State if all of the cases were to expire now; and if the leases were to expire, the market value cost of acquisition of landlords interests.
In so far as rents payable on foot of leases held by the Minister for Finance or the Commissioners of Public Works is concerned, the information sought by the Deputy is set out in the tabular statement which will be circulated with the Official Report.
In the event of failure to agree with the owner a purchase price for the fee simple of an expired lease where a ground rent was payable, the price is determined by arbitration in accordance with Section 7 (4) (a) of the Landlord and Tenant (Amendment) Act, 1984. Where the expired lease is not being bought out and the lessee is entitled to a reversionary lease, the rent is fixed in accordance with Sections 34, 35 and 36 of the Landlord and Tenant (Amendment) Act, 1980.
The calculation of total estimates, in these circumstances is not meaningful.
