Written Answers. - Disability Pension.

Question:

79 Mr. Noonan (Limerick East) asked the Minister for Defence the reason a person (details supplied) in County Limerick is not in receipt of a higher disability pension arising from injuries he received while serving in the Army.

The person in question is in receipt of a disability pension under the Army Pensions Acts based on a degree of disablement of 45 per cent as assessed by the Army Pensions Board. The pension is, however, subject to reduction in respect of compensation received by him in settlement of a civil action against the State arising from one of his pensionable disablements. In this regard, the Army Pensions Acts provide that a disability pension may be reviewed in the light of compensation received and may be either terminated or reduced. The reduction in the present case represents the actuarial value of less than 25 per cent of the compensation received.

The person's case was specially reviewed recently by the Army Pensions Board, which is the statutory authority in these matters, but the assessment of his disablement was not increased. A further review is due in the ordinary course by 31 January 1995.
