Written Answers. - Garda Investigation of Fatal Accident.

Question:

45 Mr. Durkan asked the Minister for Justice whether information relative to a fatal accident involving the son of persons (details supplied) in County Kildare on 28 November 1993, has been made available to the next of kin; if not, the reasons therefor; if the file, now with the Director of Public Prosecutions, has been dormant; if a recommendation from the Garda has been submitted to the Director of Public Prosecutions; if all of the circumstances surrounding the accident have been recorded for the Director of Public Prosecutions; if the solicitor acting for the next of kin has been, or will be, advised of the current position in the case so as to enable him advise his clients; and if she will make a statement on the matter.

I am informed by the Garda authorities that the accident was fully investigated by the Gardaí. In accordance with normal procedures, a file was then forwarded to the Director of Public Prosecutions who, having considered the case, has decided that no charges should be preferred arising from the accident. This information has been conveyed to the family of the deceased and their solicitor.

An abstract of the Garda report of the accident is being made available to the solicitor in question on the usual basis.
