Written Answers. - Appeals Tribunal Orders.

Question:

219 Mr. Bell asked the Minister for Enterprise and Employment the action, if any, he will take regarding the non-compliance with the Appeals Tribunal Orders Nos. M3417/93 and M3418/93 in a case (details supplied); if the state Solicitor's Office has decided to pursue the matter by Court action; if the company has notified his Department of any appeal by it to the Courts; if so, if it is proceeding with any such action; and if he will make a statement on the matter. [519/94]

The Employment Appeal Tribunal made awards of compensation to the employees concerned under the Minimum Notice and Terms of Employment Acts, 1973-1991. When the employer failed to implement the decision of the tribunal, the employees made complaints to my Department.

My Department wrote to the employer in June, 1994 seeking implementation of the tribunal awards and the employer responded indicating that they had appealed the tribunal's decision to the High Court and, therefore, were not in a position to make any payments to the employees until the appeal had been decided. I am advised that this matter remains the subject of High Court proceedings and that, while this continues to be the case, I am estopped from pursuing implementation of the awards.
