Question:

254 Ms McManus asked the Minister for the Environment his views on the establishment of a process outside the legal system to deal with applications for eviction. [646/94]

Generally speaking, the question relates to legal codes which are the responsibility of the Minister for Justice. However, housing legislation provides separately for legal proceedings by local authorities in relation to house purchase and improvement loans advanced by them. This legislation ensures that, in every case, an application to a court is required. I am of the view that it would be undesirable to remove the protection of the courts from occupiers and I have no proposals to amend housing legislation in this respect.
