Question:

368 Mr. Yates asked the Minister for Transport, Energy and Communications if he will alter the regulations in relation to the Transport (Tour Operators and Travel Agents) Act, 1982, with reference to a licence holder being deceased so that a smooth transfer can take place without a cessation of business to a family member or appropriate person; and if he will amend the regulations to facilitate these circumstances. Section 6 of the Transport (Tour Operators and Travel Agents) Act, 1982 specifies that the Minister shall grant a licence to carry on business as a tour operator or as a travel agent if he is satisfied that (a) the financial, business and organisational resources of such person and any financial arrangements made or to be made by him are adequate for discharging his actual and potential obligations in respect of the activities (if any) in which he is engaged or in which he proposes to engage if the licence is granted, and (b) having regard to the past activities of such person or of any person employed by him or, if such person is a body corporate, having regard to the past activities of any director, secretary, shareholder, officer or servant of the body corporate, such person is a fit and proper person to carry on business as a tour operator or travel agent, as the case may be.

These requirements must be complied with in the case of all applicants for a licence.

In the case of a sole trader, the licence is issued to the individual concerned when my Department is satisfied that he or she complies with the conditions laid down. The licence is held by that individual and lapses on the death of the holder.

In the event of the death of a licence holder, my Department makes every effort to facilitate his/her family in the issue of a new licence where this is requested.
