Question:

90 Mr. Gilmore asked the Minister for Justice if High Court proceedings are being taken against her for a declaration that Section 65 of the Courts of Justice Act, 1936, is invalid in view of the provisions of the Constitution; if she has entered a defence to this case; and if she will make a statement on the matter. [1242/94]

The position is that the Minister for Justice is cited as one of the defendants in the court proceedings referred to in the Deputy's question and which are still pending. I have been informed that the Chief State Solicitor has been in correspondence with the plaintiff in the matter and is still awaiting a reply to a letter issued to the plaintiff on 7 September 1993. In a further letter dated 20 July 1994 the Chief State Solicitor, inter alia, reminded the plaintiff of the outstanding issues raised in his letter dated 7 September 1993.

In the circumstances I do not consider it appropriate for me to make any further comment in the matter.
