Question:

189 Mr. J. O'Keeffe asked the Minister for the Environment in relation to the Register of Electors, if a person who is working away from home but returns to their parental home every weekend can be registered for electoral purposes as being ordinarily resident in their parental home; if not, the reason therefor; and if he will make a statement on the matter. [3124/94]

Part II of the Electoral Act, 1992, provides that a person is entitled to be registered as an elector in the constituency (or local electoral area) in which he or she was ordinarily resident on the qualifying date, viz., 1 September prior to the coming into force of the register.

Section 11 of the 1992 Act provides that a person may not be registered as an elector more than once. Where it appears that a person may, prima facie, be eligible for registration in respect of two or more premises, the registration authority (the county council or county borough corporation) shall, subject to any expression of choice by the person concerned, determine which of the premises the person should be registered for.

The law provides for reference to the county registrar, and appeal to the courts, in relation to any decision of the registration authority.
