22 Mr. Callely asked the Minister for Equality and Law Reform the progress, if any, that has been made towards enacting legislation to put the rights of people with a mental handicap on a statutory basis; and if he will make a statement on the matter. [3656/94]

As provided for in the Programme for a Partnership Government I am, at present, preparing legislation prohibiting discrimination on a number of grounds, including disability, which will apply to people with a mental handicap.

The objective of the legislation is to make discrimination unlawful not only in the workplace but also in education, in the provision of goods, facilities and services — including recreational facilities and services, entertainment, accommodation, transport and professional services — and in the disposal of accommodation or other premises. The legislation will comprise two Bills, the Employment Equality Bill, which deals with discrimination in the workplace, and the Equal Status Bill covering non-employment areas.
The terms of reference of the Commission on the Status of People with Disabilities require it to make recommendation setting out necessary changes in legislation, policies, organisation, practices and structures to ensure that the needs of people with disabilities are met in a cohesive, comprehensive and cost effective way. Pending receipt and consideration of the Commission's recommendations regarding the specific situation and needs of people with a mental handicap, it would be premature, at this juncture, to attempt to bring forward legislation in that respect.
