Question:

200 Mr. Haughey asked the Minister for Justice the reasons the Land Registry will not register property (details supplied) in Dublin 3; and if she will intervene in this case. [3896/94]

I am informed by the Registrar of Titles that no application in respect of the property quoted has been lodged with the Land Registry. However, I understand that following a decision of the Supreme Court in Perry v. Woodfarm Homes Ltd. (1975 IR104), it is not possible to proceed with any registration of property in a case of the type quoted by the Deputy. The court decision established, inter alia, that a squatter on unregistered leasehold property is not entitled to be registered as owner of the leasehold interest.
