Question:

84 Mr. Shatter asked the Minister for the Environment whether there are any court proceedings currently in being which are delaying the construction of the southern cross route; if so, the section of the route and the nature of the dispute to which they are relevant; the terms upon which proceedings were settled in December 1994; and the litigants with whom such proceedings were settled.[4858/95]

The order made by the Minister for the Environment on 7 August 1992 approving, with modifications, the Dublin Country Council southern cross route motorway scheme, 1991, is the subject of High Court proceedings alleging that the environmental impact study prepared by the council in respect of the project failed to comply with the relevant statutory provisions and seeking a declaration that the Minister's order is void and of no effect. I understand that the applicant, who resides at Sandyford Service Station, Sandyford. Country Dublin, is also seeking to have a new environmental impact study prepared as regards the effects of the proposed motorway on himself and his property.

Separate court proceedings concerning this motorway scheme were taken against Dublin County Council and the Minister for the Environment by Mr. Edward Fitzachary, Major Thomas Bleakley McDowell, the Select Vestry of the Parish of Whitechurch Parish and Whitechurch national school board of management. The action was settled, with the agreement of the parties, in December 1994 on terms which were received and filed by the High Court and which contain a provision binding the parties to their confidentiality. I can state, however, that the action was settled in a manner which allows for the construction of the motorway along the route as approved in August 1992.
