Question:

162 Mr. M. McDowell asked the Minister for Social Welfare if his attention has been drawn to the fact that rent allowance is not payable during a period after the serving of the notice to quit on a tenant and prior to the making of a court order for eviction, during which period the landlord cannot accept rent; if his attention has further been drawn to the fact that as a result many tenants find themselves facing a large bill for mesne rates in respect of which they have no assistance from his Department; and if he will make a statement on the matter. The Department has been informed that cases where payment of a "mesne rate" arise are very rare.

The Department has issued no guidelines on the payment of "mesne rates" and the issue of a payment in such cases would be a matter for consideration by the relevant health board. However, this issue will be kept under review in the light of any evidence arising on such cases.
