Question:

71 Mr. S. Brennan asked the Minister for Finance the views, if any he has on the award given by arbitration to a civil servant's widow in County Dublin (details supplied) following the death in service of her husband in July 1973; if he will agree that the arbitration award of one-third salary should have been one-half salary in line with changes made one month before he died; if he will make arrangements to retrospectively apply the higher amount to the recipients's pension; and if he will make a statement on the matter. I understand that the case referred to by the Deputy was reviewed by my Department in 1987, in consultation with a prominent firm of solicitors, acting on behalf of the person concerned. As a result of this review, the matter was resolved on the basis of a full and final settlement which was accepted by all parties.

The person concerned indicated, in writing on 30 March 1987, that she was prepared to accept the agreed terms in full settlement of her claim for additional benefits under the Superannuation Acts. Under the terms of the settlement, the person concerned receives 7/12 of the current equivalent of her late husband's salary.
