Question:

143 Éamon Ó Cuív asked the Minister for Justice when a dealing number (details supplied) will be completed in view of the fact that it has been awaiting registration for over ten years. [10168/95]

I am informed by the Registrar of Titles that the dealing referred to by the Deputy affects Folio 24105 County Galway, which is in the name of the person on whose behalf the Deputy is inquiring. I understand that the matter involves the boundary rectification of a number of folios belonging to various owners.

The background to the matter is that in 1975 Galway County Council lodged a scheme map for the purpose of registering various cottages under the Labourers Acts, 1936. This map conflicted with that previously lodged by the county council in respect of the registration of cottages and lands in the Land Registry. The consent of the registered owners to the rectification of the boundaries is required to amend the registry map to agree with the revised scheme map.

I understand that it is a matter for Galway County Council to obtain the various consents and that they have been unable to do so to date. The Land Registry is unable to act on the case until this matter has been resolved by the county council. I understand that the solicitors for the applicant are aware of the position. The most recent letters from the Land Registry to the solicitors are dated 5 January 1995 and 7 April 1995.
