Written Answers. - Disposal of Land in Dublin 9.

98 Ms Shortall asked the Minister for Finance if he will expedite a decision regarding the disposal of land (details supplied) in Dublin 9 in view of the fact that Dublin Corporation extinguished the public right-of-way in May 1994 and the residents of the dwellings adjoining the lane approached his Department in August 1994, requesting that they be allowed incorporate this land into their gardens. [10677/95]

Under the terms of the State Property Act, 1954 property which is undistributed on the dissolution of a company becomes State property. This is what happened in this case. When my Department was approached about this property, the normal steps were taken to establish the precise legal status of the property, its ownership etc. This is a complex and time-consuming process. Steps were also taken to establish how the State's interest in the property might properly be disposed of.

My Department has pursued this matter expeditiously in conjunction with the Chief State Solicitor's Office and the Office of Public Works and the position regarding the property has now been clarified. Consequently, it is hoped that the matter can be satisfactorily resolved in the near future.
