Written Answers. - Investigation of Complaint.

Question:

121 Miss Harney asked the Minister for Justice the reason for the delay in reporting on a complaint made by a person (details supplied) in County Kerry; and if she will make a statement on the matter. [11921/95]

The persons referred to by the Deputy wrote to me in March of this year and my private secretary replied on 31 May 1995 explaining that the complaint made is a civil matter which is outside the scope of my official functions and that I could not intervene in any way.

Under the Auctioneers and House Agents Act, 1947, an application for an auctioneer's licence or for the renewal of such a licence involves an application to the District Court for a certificate of qualification. If a certificate is granted, the applicant may then apply to the Revenue Commissioner's for a licence. Under the 1947 Act, an objection to the granting of a certificate of qualification may be made to the court by any interested person. An objection shall not be entertained by the court unless the intending objector has, at least seven days before the hearing of the application, given notice in writing of the grounds of his objection to the applicant and the District Court clerk.

If the auctioneer in question is a member of a professional body of auctioneers, it is also open to a person to complain to that body.

A check of my Department's records has failed to locate any record of the complaints made in late 1988 and early 1989.
