Vol. 457 No. 1

Written Answers. - Control of Dogs Act.

Seamus Brennan

Question:

145 Mr. S. Brennan asked the Minister for Justice her views on the legal loophole which resulted in charges under the Protection of Animals Act and the Control of Dogs Act being dismissed in the District Court on 10 October 1995 in the case of three Englishmen intercepted while attempting to board a ferry; if she will consider amendments to ensure this situation does not occur again where an alleged breaking of the law cannot be pursued; if she has satisfied herself that the Gardaí are given support in their efforts to uphold the law; and if she will make a statement on the matter. [14902/95]

I am examining the purely legal aspects of this matter and will communicate with the Deputy on this aspect as soon as I am in a position to do so. I have today received a report on certain procedural aspects of the case, in particular the question of amendment of the charges, and I will deal fully with this matter on the adjournment tonight.
