159 Mr. J. Walsh asked the Minister for Social Welfare the prosecutions, if any, that are pending under Section 224 of the Social Welfare Consolidation Act, 1993, or any other appropriate legislation, in relation to a person (details supplied) in County Kerry; if none are pending, the reason therefor; and if he will make a statement on the matter. A decision to initiate a prosecution under the Social Welfare Acts depends on the circumstances of each individual case. In general, prosecutions are not initiated in cases where there are grounds for believing that there was no intent to defraud.

There are no prosecutions pending under Section 224 of the Social Welfare (Consolidation) Act, 1993, in respect of the person concerned. The appropriate officials who dealt with the case, following normal procedures, held that, as there was no intent to defraud there was no grounds on which to initiate a prosecution.
