Question:

31 Miss Quill asked the Tánaiste and Minister for Foreign Affairs the consideration, if any, his Department has given to the contents of the Government's reply, dated 5 March 1991, to the Commission of the European Communities Article 169 Infringement Proceedings (A/90/0980) in light of the findings of fact in a judgment of Mr. Justice Costello dated 9 July 1991; and the steps, if any, his Department has taken to address the findings of fact that the company concerned was not an agent as suggested by the Government in its reply to the Commission in view of Mr. Justice Costello's views on that suggestion. The Government's reply to the Commission's letter on infringement procedures in this matter was, in the usual way, prepared by the responsible Department, in this case the Department of Agriculture, Food and Forestry. It was communicated directly to the Permanent Representation in Brussels by the Department for transmission to the Commission. The reply issued to the Commission on 5 March 1991.

The question of whether the company concerned was an agent was not a matter within the direct competance of my Department, nor is it a matter within its direct competence now. It is, therefore, a matter which should be pursued with the Minister for Agriculture, Food and Forestry.
