12 Mr. Doherty asked the Minister for Justice whether there has been a Garda investigation into any aspect of the sale of the Horgan's Quay site, Cork, to O'Callaghan Properties Limited; and if so, whether the Garda authorities saw fit to communicate the findings of any such investigation to the Director of Public Prosecutions. 39 Mr. Doherty asked the Minister for Justice the investigations, if any, conducted by the Garda into the allegations made by the Minister for Transport, Energy and Communications regarding the proposed sale of the Horgan's Quay site, Cork, by Coras Iompair Éireann to O'Callagan Properties Limited. [16540/95]

I propose to take Questions Nos. 12 and 39 together.

I am informed by the Garda authorities that no complaint has been made to them regarding criminal activity in relation to the sale of the Horgan's Quay site. Accordingly, no investigation has been carried out by them.

Furthermore, I understand that the Minister for Transport, Energy and Communications has never made any suggestion to the effect that some criminal aspect arose in connection with sale of the site in question, or that the Garda authorities should conduct an investigation into any aspect of the matter.
