Vol. 458 No. 2

Written Answers. - Protection of Tenant Rights.

Peter Barry

Question:

104 Mr. Barry asked the Minister for the Environment if the Housing (Private Rented Dwellings) Act, 1982, is under review, particularly section 9 of the Act which will cease to have effect after the year 2002; and if he is contemplating amendments that will safeguard existing tenants of controlled dwellings after the expiry date. [16824/95]

The rights, conferred by section 9 of the Housing (Private Rented Dwellings) Act, 1982, on a tenant, the spouse of a tenant or a member of the tenant's family, as defined in the Act, to occupation of a formerly controlled dwelling continue to apply until July 2002. The question of what legislative provisions may be appropriate to protect tenants after that date will be considered, within the context of the applicable court judgments, well in advance of the expiry of the existing provisions.
