Question:

394 Ms F. Fitzgerald asked the Minister for Justice the EU Directives coming wholly or partly under the auspices of her Department that were not fully implemented as of 1 January 1996; the reference number and subject matter of each Directive; the deadline for implementation set out in the Directive; whether it is proposed to implement the Directive by means of a Bill or by Statutory Instrument; and when it is proposed to implement the Directive. [19471/96]

The information requested by the Deputy in respect of my Department is as follows:

1. Council Directive 95/46/EC of 24 October 1995 deals with the protection of individuals with regard to the processing of personal data and on the free movement of such data. The Directive is to be implemented by member states by October 1998. It is considered that legislation will be necessary to enable Ireland to implement the Directive and it is the intention to introduce such legislation in good time to meet the implementation date required by the Directive.

2. Council Directive 91/308/EEC of 10 June 1991 deals with the prevention of the use of the financial system for the purpose of money laundering. The Directive has been implemented by the Criminal Justice Act, 1994, and as regards Article 11 of the Directive, by administrative measures. Article 11 deals with the establishment by credit and financial institutions of internal control procedures and employee training programmes. Consideration is being given to placing the requirements of Article 11 on a statutory basis.

3. Three EC Directives relating to Rights of Residence for Non-Economically Active Persons: Rights of Residence for students (93/96 EEC); retired persons (90/365/EEC) and other inactive persons (90/364 EEC)) were transposed into Irish law by Statutory Instrument, namely, the European Communities (Rights of Residence for Non-Economically Active Persons) Regulations, 1993. A further revision of these regulations is required as my Department has been advised that certain aspects were considered by the European Commission to be incompatible with European law. Revised draft regulations are at present being discussed with the other Departments concerned in this matter.
