581 Ms F. Fitzgerald asked the Minister for Transport, Energy and Communications the EU Directives coming wholly or partly under the auspices of his Department that were not fully implemented as of 1 January 1996; the reference number and subject matter of each Directive; the deadline for implementation set out in the Directive; whether it is proposed to implement the Directive by means of a Bill or Statutory Instrument; and when it is proposed to implement the Directive. 1. Council Directive of 3 May 1989 on the approximation of the laws of the Member States relating to electromagnetic compatibility as amended by: Council Directive 91/263/EEC of 29 April 1991 on the approximation of the laws of the Member States concerning telecommunications terminal equipment, including the mutual recognition of their conformity and

Council Directive 89/336/EEC, as amended, requires that apparatus (as defined in the Directive) shall be so constructed that the electromagnetic disturbance it generates does not cause interference to the operation of radio and telecommunications equipment and other apparatus and that such apparatus has an adequate level of intrinsic immunity to electromagnetic disturbance to enable it to operate as intended.

Council Directive 91/263/EEC as amended, requires inter alia that Member States prohibit the placing on the market of telecommunications terminal equipment which is not in the Directive

Draft regulations to give effect to Directive 91/263/EEC are well advanced and these will be made within weeks of the full clarification of certain matters currently under way with the EU Commission pertaining to the implementation of the Directive.
