Question:

613 Ms F. Fitzgerald asked the Minister for the Marine the Acts and provisions of Acts under the auspices of his Department which, as of 1 January 1996, are not in force in view of the fact that a commencement order has not been made; whether it is proposed to make such an order in each case; and if so, when. [19419/96]

Part II of the Merchant Shipping Act, 1992 had not been brought into operation on the date referred to. That Part of the Act makes provision for the introduction of new measures in regard to the licensing of small passenger ferries carrying more than 12 passengers on internal voyages within territorial waters. A number of matters remain to be addressed in relation to the implementation of the provisions in question and I can assure the Deputy that the necessary commencement order will be made as soon as practicable.

In the meantime, the vessels in question are subject to licensing and regulation under existing legislation.
