Written Answers. - Laois Forestry Grant.

Question:

280 Mr. P. Gallagher (Laoighis-Offaly) asked the Minister for Agriculture, Food and Forestry if he has sanctioned forestry grants to a person (details supplied) in County Laois; if so, if he has satisfied himself that the forestry development in question is in accordance with relevant regulations, in particular in respect of the requirement to show title to the property or written permission from the registered owner of the property; and if he will make a statement on the matter. The person concerned was grant-aided by my Department for afforestation in accordance with the conditions of the CAP afforestation scheme. Part of the land in question was registered in the name of the applicant and a copy folio was submitted for this land. The remaining land was unregistered but the applicant supplied a signed and witnessed statement that he was the full owner of the planted land.

Another individual is claiming turbrary rights over part of the planted lands but, to date, my Department has not received documentary evidence to support this claim.

However, in view of the claim, the forestry grant was paid to the applicant on foot of an undertaking lodged by him. Under this undertaking the applicant agreed to repay to my Department any grants in respect of any part of the planted lands on which a turbary claim was found to be valid by the courts, if he failed to buy out or otherwise extinguish the turbary claim to the satisfaction of the Department.
