47 Ms F. Fitzgerald asked the Minister for Health if the report of the Western Health Board investigation into the Kelly Fitzgerald case has been brought to his attention; and if he intends to publish this report. [5939/96]

The Department of Health received a copy of the report of the Western Health Board investigation into the Kelly Fitzgerald case on 8 March 1996. The report was commissioned by the Western Health Board and at a special meeting of the board on 11 March 1996 the board decided, having considered legal advice from senior counsel, to publish the general recommendations of the report. The board also decided to refer the recommendations to the community care committee and the child care advisory committee of the board for consideration.

The Department of Health is studying the report in detail and will consult with the Western Health Board on actions that need to be taken on foot of the report.
