Written Answers. - Disability Pension Payment.

Question:

100 Mr. Browne (Wexford) asked the Minister for Defence the reason a disability pension awarded to a person (details supplied) in County Wexford has not been paid; and if he will expedite the payment of this pension. [7293/96]

The person in question applied for and has been found eligible for a disability pension under the Army Pensions Acts. He has also received compensation in settlement of a civil action against this Department in respect of one of his pensionable disablements. In this regard, the Army Pensions Acts provide that alternative compensation received may be taken into consideration in fixing the level of disability pension.

The question of whether all or some of the compensation received by him should be taken into account is under consideration and his solicitors have, at the Department's invitation, recently furnished representations on his behalf in this context. The matter will be decided as quickly as possible at which stage the Department will notify his solicitors of the outcome.
