Written Answers. - Delay in Departmental Response.

38 Mr. Molloy asked the Minister for Finance the reason for the delay in replying to a letter dated 14 December 1995 on behalf of a person (details supplied) in Galway; and if he will make a statement on the matter. [6929/96]

The matter referred to in the Deputy's letter of 14 December 1995 comes under the State Property Act, 1954.

Following the dissolution, on 16 October 1992, of the company registered as owner, the assets of the company now vest in the Minister for Finance by virtue of section 28 (2) of the State Property Act, 1954. Under section 31 of that Act it is open to the Minister to waive his interest in these assets.

On receipt of the Deputy's letter the matter was referred immediately to the Chief State Solicitor for investigation. As soon as the facts of the case were establised a reply was issued to the Deputy. There was no delay in dealing with the matter.

It is understood that the directors of the company propose making an application to the High Court with a view to having the company reinstated on the Register of Companies.
