Vol. 464 No. 7

Written Answers. - Court Decisions.

Noel Ahern

Question:

105 Mr. N. Ahern asked the Minister for Justice whether she will introduce regulations which will require the court system to make a decision within a specified time of a case being heard; her views on the current system where in at least one case judgement was reserved almost a year ago and a decision is still awaited; and if she will make a statement on the matter. [8906/96]

I understand that the practice of reserving judgement in a case is a matter entirely within the discretion of the judge hearing the case and it would be inappropriate to introduce legislation in this area. While it would not be proper for me to comment on a particular case, the matter of giving judgements within a specified time is one which the working group on a courts commission might consider appropriate for consideration by them. I will arrange to bring it to the attention of the working group.
