Vol. 466 No. 5

Written Answers. - Receivership and Liquidation Legislation.

Trevor Sargent

Question:

127 Mr. Sargent asked the Minister for Enterprise and Employment the plans, if any, he has to change legislation regarding receivership and liquidation. [11905/96]

I have no plans at present to bring forward legislative changes in the areas of receivership and liquidation.

However, one of the areas examined by the company law review group concerned Chapter 1 of Part VII of the Companies, Act, 1990, in regard to the restriction of directors of insolvent companies. These provisions can also apply in receiverships. Proposals for legislative change in this area are under consideration at present.
