137 Mr. Creed asked the Minister for Agriculture, Food and Forestry the reason a milk quota lease (details supplied) which was originally rejected due to time limits, was rejected on appeal on the basis of alleged invalidity of the lease; and the reason correspondence from the lessee's solicitor (details supplied) has not been replied to. 138 Mr. Creed asked the Minister for Agriculture, Food and Forestry if he will facilitate a person (details supplied) in County Cork with an allocation of national flexi-milk for the year 1995-96 in view of the circumstances surrounding a lease which was ultimately rejected by his Department in May 1996 and which the applicant believed to be valid until that date. [11804/96]

I propose to take Questions Nos. 132 to 138, inclusive, together.

An application for the transfer of milk quota to the person named was made to my Department. In considering this application, my Department took account of all the documentation submitted directly by those persons involved in this case or by their legal representatives. All correspondence was dealt with in my Department without delay.
Having considered the application, my Department was not satisfied that the proposed transfer was in accordance with EU Regulations 3950/92 and 536/93 and with the European Communities (Milk Quota) Regulations, 1995 (S.I. No. 266/95). Accordingly, the transfer of milk quota to the person named was not effected.
