Question:

118 Mr. E. O'Keeffe asked the Minister for Finance the reason a disabled person (details supplied) in County Cork has not qualified for a disabled person's driver concession. [15944/96]

I am informed by the Revenue Commissioners that they have not received any application from the person concerned for repayment of tax under the Disabled Drivers and Disabled Passengers (Tax Concessions) Regulations 1994. Consequently, an application for repayment has not been refused in this case.

As the Deputy is aware, in order to be eligible for repayment under this scheme, a person must meet the medical criteria set down in the regulations and must furnish to the Commissioners a primary medical certificate issued by the appropriate director of community care and medical officer of health. While it is unclear from the Deputy's question if a medical certificate was in fact refused in this case, if it was, there is provision under the regulations to appeal this decision to the medical board of appeal.

I am informed that a copy of the public notice, Notice 1851A which deals with this scheme has been sent to the person concerned.
