876 Mr. Ring asked the Minister for Agriculture, Food and Forestry when consent will be forthcoming to subdivide and sell part of a folio (details supplied) in County Mayo in view of the fact that the delay is holding up the sale of property and causing financial hardship. [15624/96]

The lands in folio 29835 County Mayo were the subject of a commonage division scheme prepared by the Land Commission. The Vesting Order relating to the commonage was completed on 22 August 1995. However, due to an objection raised by one of the shareholders concerning a right of way, the Land Commission has not been in a position to lodge the Vesting Order in the Land Registry. Consequently, none of the shareholders can be registered as owners of their defined plots for the present. The Land Commission cannot consent to the proposed transfer until such time as the objection has been resolved.

The objection will be referred to the Court of the Irish Land Commission for hearing at the earliest opportunity. Details are being sought on the current usage of the right of way from the other commonage owners and from the occupiers of the relevant adjacent folios. The case will be expedited as much as possible.
