479 Mr. M. Kitt asked the Minister for Justice if she will investigate the reason bailiffs were dressed in black and wore balaclavas during an operation to evict a family (details supplied) in County Donegal; and if she will make a statement on the matter. [16247/96]
I would like to stress at the outset that I have no function in relation to the enforcement of individual Court Orders.
Under the Enforcement of Court Orders Acts, 1926 to 1940 and Rules of Court made under these Acts, the Sheriff or County Registrar acting as Sheriff, who is a Statutory Officer and is independent in the exercise of his functions, is responsible for the enforcement of Court Orders. These orders are a direction by the court to the sheriff, or county registrar commanding him or her to seize whatever goods are within his or her bailiwick belonging to the judgment debtor and to produce the sum due to the judgment creditor out of their sale.
