Question:

521 Miss Harney asked the Minister for Justice the reason an application for repatriation by a person (details supplied) has been disallowed to date; and if she will make a statement on the matter. [16884/96]

The person referred to in the question has submitted an application for a transfer to a prison in the United Kingdom under the Transfer of Sentenced Persons Act, 1995. The application and the necessary accompanying documentation was forwarded to the UK authorities earlier on this year. The UK authorities recently sought additional information to substantiate the person's claim to be a British citizen or to have the right of abode in the UK. This request has been brought to the person's attention but, to date, the required information has not been provided.

I would also like to assure the Deputy that I have not disallowed this application. On the contrary, I have indicated that I have no objections, in principle, to the request for a transfer but I am not in a position to give my formal consent until the UK authorities have considered the application further.
