194 Mr. Callely asked the Minister for the Environment his views on whether the area of the east mountain be included in the special amenity order due to the vast area zoned high amenity of moorland on the east mountain in view of his recent directive for a special amenity order to be placed on the west mountain in Howth, County Dublin; and if he will make a statement on the matter. [18350/96]

I have directed Fingal County Council to make a Special Amenity Area Order in relation to the area in the Dublin County Development Plan 1993 included in objective G, to protect and improve high amenity areas, and lying to the seaward side of the R105 road commencing at its junction with Strand Road and terminating at the junction of Abbey Street and Harbour Road. The direction includes the area known as East Mountain.

It is now a matter for the council to proceed with the making of the Order and in so doing, it is open to them to include any additional areas which they consider should be covered by the Order. The making of such an order is a reserved function of the elected council; an order, when made, will be subject to confirmation by the Minister and must be laid before each House of the Oireachtas.
