33 Mr. McCreevy asked the Minister for Justice the number of prosecutions which have been brought against officers of companies or other persons under section 34 of the Companies Act, 1990, which prohibits illegal credit transactions with companies in each of the years since the introduction of the Act. The Companies Act, 1990, is the responsibility of my colleague, the Minister for Enterprise and Employment.

I am informed by the Garda authorities that no complaints have been made to the gardaí in relation to section 34 and, accordingly, no prosecutions have been initiated by the gardaí under this section.
