37 Mr. J. Walsh asked the Minister for Justice the reason she will not agree to the appointment of the Deputy State Pathologist located in Cork; and if she will make a statement on the matter. [5420/97]

The State pathologist or a pathologist nominated by him carried out 100 post mortems under section 33 (2) of the Coroners Act, 1962 in 1996.

Almost 50 per cent of these post mortems are in the Dublin region, while the rest are spread throughout the country. In these circumstances I consider that the deputy State pathologist must be prepared to carry out post mortem examinations anywhere in the 26 countries. For this reason the post has been advertised as being based in Dublin with a countrywide commitment.
