184 Miss Harney asked the Minister for Justice the reason a person (details supplied) has not been repatriated to Britain in view of the fact that the British Home Office has finalised all appropriate paperwork and has accepted this prisoner; and if she will make a statement on the matter. [6471/97]

The person referred to in the question has applied for a transfer to the United Kingdom under the terms of the Transfer of Sentenced Persons Act, 1995. The UK authorities recently responded to the application. However, a legal issue has since arisen in this case and this has been referred to the Attorney General for advice. When this advice has been received, I expect to be in a position to make a final decision on the person's application.
