Question:

113 Mr. Gregory asked the Minister for Social Welfare if he will review the decision to refuse deserted wife's allowance to a person (details supplied) in Dublin 10 whose husband left due to alcoholism and severe depression. [7228/97]

The person concerned applied for lone parent's allowance — now one parent family payment — in March 1996. Her application was refused on the grounds that she was being adequately maintained by her husband.

She applied for deserted wife's benefit in September 1996. Her claim was rejected on the grounds that she had not been deserted within the meaning of the relevant legislation.

The Deputy's question has been accepted as an appeal against the decision on her latest claim. The case is being forwarded for consideration by the independent Social Welfare appeals office. That office will be in contact with her shortly.
