Question:

295 Mr. Cowen asked the Minister for Agriculture, Food and Forestry if 1996 suckler cow and cattle headage premia have been paid to a person (details supplied) in County Offaly. [9120/97]

The herd owner was deemed to have made a false declaration through serious negligence by applying for suckler cow premium and cattle headage on an animal which he sold a month before he lodged his application with the Department. The penalty for false declaration through serious negligence is exclusion from the schemes for one year. The herd owner appealed this decision but the appeal was unsuccessful. The herd owner was notified of the outcome on 25 March 1997. He will not receive any payments under the 1996 suckler cow premium or cattle headage schemes.
